1. Scope

These terms apply to the use of the "HeyFini" app and this website, provided by Felix Plaschka (see Imprint).

2. Service

HeyFini is an app for recording everyday and health data about a baby (e.g. breastfeeding, sleep, diapers, growth) and for showing general information (e.g. clothing, checkups). The data is stored in your iCloud.

3. Not medical advice

HeyFini is not a medical device and does not replace medical or professional advice, diagnosis or treatment. All guidance (e.g. clothing recommendations, TOG values, temperature classification, checkup dates) is general orientation. The AI expert chat also provides only general, AI-generated information – including about uploaded photos – and does not constitute a diagnosis or a treatment/medication recommendation; answers can be wrong. If in doubt or for health questions, please consult your pediatrician or midwife. In an emergency, call the emergency number immediately (112).

4. Account

An account is optional and is required for HeyFini Pro and the AI features. You are responsible for keeping your credentials confidential and confirm that you provide truthful information. You can have your account deleted at any time.

5. HeyFini Pro (subscription)

HeyFini Pro is an optional, auto-renewing subscription (monthly or yearly) and unlocks, among other things, the AI expert chat, calendar/preview, predictions and family sharing. Purchase and billing are handled via your Apple App Store account; the prices shown in the app apply. The subscription renews automatically for the chosen period unless cancelled at least 24 hours before the end in the App Store settings. Any free trial offered ends automatically; if you don't cancel in time, it converts into a paid subscription. Management and cancellation are done in the Apple subscription settings.

AI chat usage limits: to prevent abuse and distribute the cost of the service fairly, the AI expert chat is subject to a cap on requests per day and a monthly processing allowance per account. The applicable limits and your current usage are shown in the app; once a limit is reached, the chat becomes available again the next day or month. All other Pro features remain unaffected.

6. User obligations

You use the app on your own responsibility and do not use it abusively or unlawfully. Only upload content to the AI chat that you are entitled to have processed.

7. Availability

We strive for high availability but cannot guarantee uninterrupted access (e.g. due to maintenance or third-party services such as iCloud or AI providers).

8. Liability

We are liable without limitation for intent and gross negligence, as well as under the Product Liability Act and for injury to life, body or health. Otherwise we are liable only for breach of essential contractual obligations and limited to the foreseeable, contract-typical damage.

9. Data protection

Information on the processing of personal data can be found in the privacy policy.

10. Changes

We may adapt these terms; we will inform you of material changes in a suitable manner.

11. Applicable law

The law of the Federal Republic of Germany applies.
